Anti-money laundering (AML) consists of a set of procedures and checks that are designed to detect and prevent money from illegal sources entering the legitimate financial system. The concept of money laundering is to cleanse money obtained from illegal activities and disguise its origins so that it is accepted by the financial community. The concept of anti-money laundering is to prevent that activity taking place.
The original anti-money laundering practices were intended to curtail the proceeds of crime – particularly organised crime – and were introduced in the early 1980s. However, anti-money laundering practices gained additional momentum following the 9/11 terrorist activities.
The ways of detecting money laundering activities generally fall into two categories – detecting suspicious activity and detecting activity of suspicious persons. One way of detecting suspicious activity is by comparing the activity of a given account or customer against the typical activity of its peer groups. Other methods include identifying large cash deposits, or multiple or repetitive deposits that are just under a reporting threshold, unusual money transfer activity, purchase or sale of unusual amounts of cash equivalents such as travellers cheques and the like. Detection of activity by suspicious persons is normally achieved through the Know Your Customer (KYC) directives. The identification provided by the customer is checked against various governmental sanctions lists that contain the names of politically exposed persons (PEP) or other ‘blacklisted’ persons or bodies. These lists, which include national lists as well as international lists such as the UN list, are sometimes referred to generically as OFAC lists after the Office of Foreign Asset Control in the US Government which produced one of the original lists.

It is now recognised that anti-money laundering practices and procedures are different to those of anti-terrorist financing. It is now recognised that they are two are separate activities.
There are specialist systems available that help banks in detecting suspicious activity. Some of these systems use artificial intelligence to monitor account activity while others use a rules-based approach.
When suspicious activity is recognised, the system will generate an exception notice that is sent to the bank’s anti-money laundering officer (AMLO) for examination. If it is warranted then the AMLO will notify the appropriate governmental organisation using a suspicious activity report (SAR).
KYC is the acronym for Know Your Customer, which in turn refers to the obligation of a financial institution to know its customers and know who it is dealing with. The KYC requirements are part of the anti-money laundering and anti-terrorist financing measures.
A financial institution is required to obtain proof of identity of its customers, especially new customers opening accounts. The customer names and addresses are then to be compared to sanctions lists of suspicious or designated persons that are regularly produced by government agencies. Sometimes these lists are referred to generically as OFAC lists after one of the original lists that was produced by the Office of Foreign Assets Control of the US government.
Many modern computer systems will have some form of system-based check-list that verifies that all relevant documents have been received and notes any documents or proof of identity checks that may be outstanding. Normally financial activity into or out of the associated accounts for that customer will not be allowed until the KYC checks are complete.
